Terms of Service
The operating rules for using Coinwaka across trading, wallets, P2P, Earn, APIs, rewards, and support. These terms are written to be clear enough for users and complete enough for a financial platform.
This page is a platform policy, not legal advice to users. Product availability, limits, and regulatory treatment may vary by country, account status, and verification level.

Agreement to these terms
These Terms of Service ("Terms") govern access to and use of services provided by Chainwaka Technologies ("Coinwaka", "we", "us"), including Coinwaka websites, mobile applications, APIs, wallets, trading interfaces, P2P marketplace, Earn products, support channels, and related services.
By creating an account, signing in, placing an order, depositing assets, using an API key, or otherwise using Coinwaka, you agree to these terms, the Privacy Policy, fee schedules, risk disclosures, product rules, and any supplemental terms shown for a specific service.
- If you use Coinwaka for a company or institution, you confirm that you are authorized to bind that entity.
- If you do not agree to these terms, you must not access or use Coinwaka services.

Eligibility, onboarding, and verification
You must be at least 18 years old, legally capable of entering into binding agreements, and located in a jurisdiction where your use of digital asset services is permitted. We may restrict access from unsupported jurisdictions or from users subject to sanctions, court orders, or regulatory restrictions.
Coinwaka may require identity verification, business verification, source-of-funds information, beneficial ownership details, enhanced due diligence, proof of address, payment-method verification, device checks, or other information before enabling or continuing access to selected services.
- You must provide accurate, current, and complete information.
- You must update your information when it changes.
- We may refuse, suspend, or terminate access when verification is incomplete, inconsistent, expired, or not reasonably satisfactory.

Account security and authorized activity
You are responsible for protecting your sign-in credentials, passkeys, two-factor authentication devices, API keys, withdrawal addresses, anti-phishing code, recovery codes, and any device used to access Coinwaka. Activity performed through your authenticated account is treated as authorized unless we determine otherwise after investigation.
You must notify Coinwaka immediately if you suspect unauthorized access, credential compromise, SIM-swap risk, device theft, malware, phishing, or any transaction you did not authorize.
- Use strong, unique passwords and keep 2FA enabled.
- Do not share accounts, sell accounts, rent accounts, or let another person trade or transact through your account.
- Coinwaka may delay withdrawals, lock sessions, require re-verification, or disable API keys when risk signals are detected.

Platform services
Coinwaka may provide spot trading, convert, margin, derivatives interfaces, P2P trading, digital asset wallets, fiat rails, marketplace escrow, Earn products, referral rewards, promotions, APIs, alerts, AI tools. Available services vary by jurisdiction, account status, asset, risk score, liquidity, and operational readiness.
Coinwaka may add, modify, pause, delist, limit, or discontinue services, assets, trading pairs, networks, order types, promotions, or payout methods at any time when required for security, compliance, market integrity, product quality, liquidity, maintenance, or business reasons.

Trading, orders, and execution
Orders are subject to matching-engine rules, liquidity, risk controls, minimum sizes, precision limits, price bands, circuit breakers, system availability, and applicable fees. A submitted order is not guaranteed to execute. Executed orders are generally final and cannot be reversed except where Coinwaka determines that correction is necessary due to a platform error, market integrity issue, legal requirement, or abusive activity.
Market prices can move quickly. You are responsible for reviewing order details, asset symbols, networks, quantities, prices, leverage, margin requirements, liquidation risks, and fees before submitting any order.
- Coinwaka does not provide investment, tax, legal, or financial advice.
- Past performance, displayed yields, rankings, AI outputs, or market analytics do not guarantee future results.
- You are responsible for your own trading decisions and tax obligations.

Wallets, custody, deposits, and withdrawals
Digital asset deposits and withdrawals depend on blockchain networks, validators, miners, bridge providers, liquidity providers, payment processors, and other third parties that are outside Coinwaka control. Blockchain transactions are irreversible once confirmed or broadcast.
You must confirm the correct asset, network, destination address, memo, tag, bank account, mobile money number, or payment reference before sending funds. Coinwaka may not be able to recover assets sent to the wrong address, wrong network, unsupported contract, missing memo, or third-party recipient.
- Deposits may require confirmations and risk review before crediting.
- Withdrawals may be delayed for security, compliance, liquidity, network congestion, maintenance, or fraud-prevention review.
- Coinwaka may set limits, holds, cooldowns, address allowlists, or manual review for selected transfers.

P2P, marketplace escrow, and third-party dealings
P2P and marketplace features allow users to interact with other users. Coinwaka may provide order flows, messaging, reputation tools, risk warnings, escrow controls, dispute workflows, and release controls, but Coinwaka is not the buyer or seller in user-to-user transactions unless expressly stated.
For P2P payments, you must verify that the sender name, payment reference, amount, and payment method match the trade instructions before releasing crypto. Do not release crypto for third-party payments, mismatched names, reversible payments, suspicious receipts, or pressure tactics.
- Triangle fraud, receipt forgery, chargeback abuse, off-platform settlement, and coercion are prohibited.
- Coinwaka may freeze escrow, request evidence, reverse reputation effects, restrict merchants, or suspend users involved in abusive P2P behavior.

Earn, rewards, and promotions
Earn, staking, launchpool, referral, reward, and promotional products may be subject to product-specific terms, availability windows, caps, lockups, eligibility criteria, yield calculation rules, early redemption limits, and risk disclosures. Displayed APR, APY, reward estimates, or bonus amounts may change and are not guaranteed unless expressly fixed in product terms.

Fees, taxes, and pricing
You agree to pay all applicable trading fees, spread, withdrawal fees, network fees, fiat processing fees, inactivity fees where applicable, margin interest, liquidation fees, conversion fees, and other charges shown before or after a transaction. Fee schedules may change, and network fees can change without notice based on blockchain conditions.
You are responsible for determining, reporting, and paying any taxes, duties, levies, withholding, or assessments arising from your use of Coinwaka.

Prohibited use and market integrity
You must not use Coinwaka for illegal activity, sanctions evasion, money laundering, terrorist financing, fraud, scams, ransomware, darknet markets, trafficking, market manipulation, wash trading, spoofing, layering, front-running, abusive API activity, exploit attempts, unauthorized access, or activity that harms users, Coinwaka, or market integrity.
You must not create multiple accounts to bypass limits, abuse promotions, manipulate referral rewards, evade KYC, avoid risk controls, or hide beneficial ownership.

Compliance, investigations, and account restrictions
Coinwaka may monitor transactions, screen sanctions lists, review blockchain analytics, investigate suspicious activity, respond to legal process, and share information where required or permitted by law. We may pause, reject, cancel, reverse where possible, freeze, or report transactions and accounts for security, compliance, legal, or risk reasons.
We may retain information and assets when required by law, court order, regulator instruction, law-enforcement request, dispute process, liquidation process, insolvency process, or internal investigation.

Risk disclosure
Digital assets are volatile and may lose value rapidly. Trading, margin, derivatives, staking, Earn, DeFi-related yields, P2P, marketplace escrow involve material risks, including total loss, liquidation, smart-contract failure, custody risk, regulatory change, liquidity gaps, network failures, issuer failures, slippage, and operational outages.
You should only use products you understand and only risk funds you can afford to lose.

Disclaimers and limitation of liability
Coinwaka services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Coinwaka disclaims warranties of uninterrupted availability, profitability, merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Coinwaka and its affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including lost profits, lost opportunities, trading losses, data loss, reputational loss, or losses caused by events outside our reasonable control.

Changes, suspension, and termination
We may update these terms from time to time. Material updates will be communicated through the platform, email, or other reasonable means. Continued use after the effective date means you accept the updated terms.
You may close your account when obligations are settled. Coinwaka may suspend, restrict, or terminate access where required for compliance, risk, security, product integrity, unpaid fees, legal obligations, or violation of these terms.

Governing law and contact
These terms are governed by the laws of the Republic of Kenya, unless mandatory consumer or financial-services laws in your jurisdiction require otherwise. Disputes should first be raised through Coinwaka Support so we can investigate and resolve them promptly.
